Terms and Conditions of Service

These Terms and Conditions ("Terms") govern the provision of services by DriveSmart Solutions ("we", "us", "our") to any client organisation or individual ("Client", "you"). By booking, commissioning, or receiving services from DriveSmart Solutions, you agree to be bound by these Terms.

1. Services

DriveSmart Solutions provides professional fleet driver services including, but not limited to:

  • Driver inductions

  • On-road driver assessments

  • Vehicle safety and compliance checks

  • Targeted driver training

  • Collision aftercare and post-incident support

  • Written assessment reports and recommendations

Services are delivered in accordance with current UK legislation, DVSA best practice, and Roadcraft principles.

2. Nature of Services (Important)

All services provided by DriveSmart Solutions are training, assessment, and advisory services.

  • Services are not driving tests.

  • We do not certify, license, or authorise drivers to operate vehicles.

  • Ultimate responsibility for driving decisions remains with the driver at all times.

3. Client Responsibilities

The Client confirms and accepts responsibility for ensuring that:

  • Drivers hold a valid licence for the category of vehicle used

  • Vehicles are roadworthy, insured, taxed, and legally compliant

  • Drivers are fit to drive (including fatigue, medication, eyesight, and health)

  • Company policies and procedures are communicated to drivers

DriveSmart Solutions relies on information provided by the Client and accepts no liability for inaccuracies.

4. Driver Responsibilities

Drivers participating in any DriveSmart Solutions service confirm that they:

  • Hold the appropriate driving licence

  • Are not under the influence of alcohol, drugs, or medication affecting driving

  • Will comply with lawful instructions during training or assessment

  • Remain responsible for all driving decisions while in control of a vehicle

5. Assessor Authority & Safety

DriveSmart Solutions assessors reserve the right to:

  • Pause, terminate, or abandon an assessment

  • Instruct a driver to stop driving where safety concerns arise

  • Take control of a vehicle if necessary to reduce immediate risk

Such actions are taken solely in the interest of safety and do not constitute liability or fault.

6. Assessment Outcomes

Assessment outcomes, scores, and reports:

  • Reflect professional opinion at the time of assessment

  • Are based on observed behaviour and available information

  • Do not guarantee future performance or incident prevention

Reports are advisory and should be considered alongside internal policies and management decisions.

7. Limitation of Liability

To the fullest extent permitted by law:

  • DriveSmart Solutions shall not be liable for indirect or consequential losses

  • We shall not be liable for collisions, damage, penalties, or incidents occurring before or after services

  • Our total liability shall not exceed the value of the services provided

Nothing in these Terms excludes liability for death or personal injury caused by negligence.

8. Data Protection & Confidentiality

DriveSmart Solutions processes personal data in accordance with UK GDPR and the Data Protection Act 2018.

  • Assessment records may contain personal and sensitive information

  • Data will be retained only as long as necessary for legal and operational purposes

9. Intellectual Property

All training materials, assessment frameworks, reports, and documents remain the intellectual property of DriveSmart Solutions unless otherwise agreed in writing.

10. Cancellation & Fees

Cancellation terms, fees, and payment arrangements will be agreed at the time of booking or contract.

Where a course, assessment, or training session is cancelled by the Client within 48 hours of the scheduled start time, the full charge for the booked service will apply. This includes cancellations, postponements, or non-attendance.

DriveSmart Solutions reserves the right to invoice for the full agreed fee where short-notice cancellation prevents the reallocation of resources.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Acceptance

By commissioning or participating in DriveSmart Solutions services, the Client and participating drivers acknowledge that they have read, understood, and accepted these Terms and Conditions.
